As a business-to-business (B2B) application and filing service, we operate independently and are not affiliated with the IRS or any other federal or state organizations. Our aim is to offer a straightforward and hassle-free way to secure your Federal Tax ID or EIN number, providing support for any inquiries you may have along the way. By relying on our filing experts, you can avoid the typical stress associated with navigating federal filing processes, allowing you to concentrate on growing your business instead of dealing with government offices or websites.

Please read this page carefully. The following Terms of Use (“Terms”) create a legal agreement between you and EIN Filing Services LLC, referred to as “Apply EIN Number” “we,” “us,” or “our.” These Terms govern your access to and use of the website www.apply-ein-number.com and its subdomains (collectively referred to as the “Website” or “Site”), as well as all portals, products, services, events, and interactive features linked to these Terms (collectively, the “Services”). By using our Services, you agree to adhere to these Terms. We reserve the right to update these Terms or modify the features of the Site or Services at any time. The latest version will be displayed on the Site with an effective date. Your continued use of the Services after any changes indicates your acceptance of those modifications. If you do not agree with the Terms, please do not use our Services. Keep in mind that these Terms include an arbitration provision and a waiver of class action and jury trial rights.

If you access our Services on behalf of an entity or individual, you confirm that you have the authority to bind that entity or individual. Our Services are not intended for individuals under 18 years of age; by accessing our Services, you confirm that you are at least 18. 2. Electronic Communications and User Content

By using our Website or Services, you agree to receive electronic communications and acknowledge that all agreements, notices, disclosures, and other communications provided to you electronically, via email and on the Site, meet any legal requirements for written communication.

Unless specifically requested, EIN Filing Services does not seek to receive any confidential, proprietary, or trade secret information from you through the Site (including any contact email available in our Services). You remain entirely responsible for any materials you submit to us, including but not limited to information, requests, creative works, images, photographs, letters, documents, demos, ideas, suggestions, reviews, concepts, methods, systems, designs, plans, techniques, or any other materials transmitted to us (“User Content”). By sending us any User Content, you grant EIN Filing Services a royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive, and fully transferable right and license to use, copy, reproduce, modify, adapt, print, publish, translate, create derivative works from, compile, and distribute, perform, display, license, and sublicense (through multiple tiers) such User Content in any media now known or hereafter developed, including for commercial purposes. Additionally, when you post comments or reviews on our Site or through social media mentions, you grant us the right to use the name, username, or profile associated with that content.

You agree not to provide User Content that:

  • Violates the copyright, trademark, patent, or other intellectual property rights of any third party;
  • Is false, misleading, defamatory, obscene, abusive, hateful, or sexually explicit;
  • Breaches a third party’s right to privacy or publicity;
  • Degrades others based on gender, race, class, ethnicity, national origin, religion, sexual orientation, disability, or other classifications;
  • Contains language or material intended to intimidate or incite violence;
  • Includes viruses, worms, Trojan Horses, time bombs, or any other harmful programs or components;
  • Contains commercial material or solicits funds (charitable or commercial), perpetuates chain letters or pyramid schemes, promotes commercial entities, or engages in other commercial activities; or
  • Violates any applicable local, state, national, or international laws or promotes illegal activities.

We are not required to use your User Content and may delete, modify, repurpose, move, or remove any User Content at our discretion. We do not guarantee confidentiality regarding any User Content. Under no circumstances will EIN Filing Services be liable for User Content provided through the Services by you or any third party.

Your obligations under these Terms will continue even after the termination of the Site or Services, any usage by you of the Site or Services, or the termination of these Terms, including any User Content uploaded or sent through the Site.

3. Prohibited Conduct

You are prohibited from accessing or using, or attempting to access or use, the Services in any way that could harm us or any third party, disrupt the operation of the Services or the Site, or violate any laws. For instance, you must not:

  • Impersonate any individual or entity, or falsely represent your connection with any person or entity or the source of any information you provide;
  • Engage in unauthorized methods of collecting content or personal data, such as spidering, scraping, or harvesting, or use any automated means not authorized by us to gather information;
  • Obtain or attempt to gain unauthorized access to other computer systems, materials, information, or services available on or through the Site;
  • Use any device, software, or routine to interfere with or attempt to interfere with the normal operation of the Site or Services, or to probe, scan, test the vulnerability of, or breach the security of any system or network;
  • Circumvent, reverse engineer, decode, decompile, disassemble, decrypt, or otherwise modify or interfere with (or assist others in doing so) any software that is part of the Site. The use or distribution of tools aimed at compromising security (such as password cracking programs or network probing tools) is strictly forbidden;
  • Take actions that place an unreasonable or disproportionately heavy burden on our network or infrastructure;
  • Upload or transmit any communication, software, or material containing a virus or that could harm the computers or systems of EIN Filing Services or its users;
  • Send or cause to be sent any communications (including emails) to other users without their permission (e.g., “mailbombing” or “spamming”);
  • Violate or promote conduct that would breach any applicable international, federal, state, or local laws or regulations;
  • Engage in fraudulent activities or misuse the Services;
  • Cause damage, embarrassment, or negative publicity to EIN Filing Services; or
  • Engage in any conduct that restricts or inhibits others from using or enjoying the Site, or that, in our sole discretion, exposes us or any of our users, affiliates, or other third parties to liability, damages, or harm.

Violations of network or system security may lead to civil or criminal consequences. We may investigate such violations and collaborate with law enforcement to take action against users who breach these Terms. We reserve the right to suspend or terminate your access to the Site at any time, for any reason, without notice. 

4. Account Registration

To access and utilize the Services, you may need to register for an account (“Account”). You agree to provide accurate, up-to-date, and complete information during the registration process and to keep that information updated. If you create an Account, you are responsible for keeping your account and password confidential and for limiting access to your computer or device. You also accept responsibility for all actions that occur under your registration, username, password, and/or Account. We strongly advise against sharing your Account credentials with anyone. We reserve the right to terminate your password, Account (or any part of it), or access to the Site at our discretion, for any reason or no reason at all. EIN Filing Services will not be liable to you or any third party for any termination of your access to the Site. If your access as a user is terminated, you agree to (i) cease using the website and any information obtained from it, and (ii) delete all copies of your account information, password, and any information acquired from the Site.

5. Restricted access

Access to certain sections of the Site may be limited. EIN Filing Services reserves the right to restrict access to additional areas of the Site, or even the entire website or portal, at its sole discretion.

If EIN Filing Services provides you with a user ID and password to access restricted areas of the Site or other content and services, you must keep this information confidential.

EIN Filing Services may deactivate your user ID and password at its discretion, without prior notice or explanation.

6. Content Accuracy and Invitation to Purchase

EIN Filing Services has taken care in preparing the content of the Site, ensuring that prices are accurate at the time of publication and that all products are described fairly. Please note that packaging may differ from what is shown. The weights, dimensions, and capacities provided are approximate. We have made every effort to display the colors of our products as accurately as possible on the website. However, actual colors may vary based on your monitor, and we cannot guarantee that your display will reflect the product’s true color upon delivery. To the extent permitted by applicable law, EIN Filing Services disclaims all warranties, express or implied, regarding the accuracy of information in any materials on the Site. EIN Filing Services will not be liable for any loss or damage resulting from the use of information or products featured on the Site.

All products, services, and information presented on the Site are considered an invitation to offer. Your order for purchase is your offer and is subject to the Terms outlined here. EIN Filing Services reserves the right to accept or reject your offer, in whole or in part. Acceptance of your order occurs upon dispatch of the ordered product(s). Dispatch may occur at different times, and in such cases, any portion of the order that is dispatched will be considered accepted by EIN Filing Services, while the remaining items will still be offered to EIN Filing Services, which retains the right to accept or reject those items. No action or inaction by EIN Filing Services prior to the actual dispatch of the ordered product(s) constitutes acceptance of your offer. If you provide your email address, we will notify you as soon as possible to confirm receipt of your order and follow up with an email to confirm dispatch, thereby accepting your order.

7. Additional Terms and Conditions

When using the Site or Services, you may be asked to agree to additional policies or terms and conditions beyond these Terms. Please review any supplemental policies and terms thoroughly before utilizing those specific areas of the Site or Services. Any supplemental terms will not change or replace these Terms for your use of the Site, unless explicitly stated otherwise.

8. Cancellation/Refund Policy

If you request to cancel our Services after we have begun processing your order but before completing the application review and filing of your EIN application, we will provide a full refund. However, if a cancellation request is received, a partial refund may be issued based on the status of your order:

  • If we have started processing your order but have not yet completed the Services, such as reviewing the application for accuracy or requesting additional information, we may refund 50% of your payment.
  • If we have finished our Services, including reviewing the application and submitting it to the IRS, but an EIN number has not been issued due to a 101 error, we may also refund 50% of your payment. 

No refunds will be granted once an EIN number has been issued or when Services have been obtained from the IRS on your behalf.

To request a refund, please contact customer service. Refunds will be issued to the original credit card or payment method used and will be processed within seven (7) business days. We cannot be held responsible if you cannot receive a refund due to the original payment method being invalid, closed, canceled, or restricted for any reason.

We are a business-to-business (B2B) application assistance and filing service that acts as a Third-Party Designee to help clients obtain an EIN from the IRS. While we provide support in this process, we are not affiliated with the IRS or any federal or state agencies. Our paid service features a streamlined application process, agent reviews of applications, and direct error resolution with the IRS on your behalf. Additionally, we provide customer support to help you check the status of your order and access your EIN and business information at any time. Alternatively, you can visit the official IRS.gov website to complete your EIN Application for free on your own.

10. Intellectual Property

EIN Filing Services values the intellectual property rights of others and expects you to do the same. This Website contains content protected by copyright, trademark, and other intellectual property laws in the United States and other countries (“Content”), and these rights are valid in all forms, media, and technologies currently in existence or developed in the future. Unless stated otherwise in these Terms or indicated elsewhere on the Website, all intellectual property rights in the Content are owned by us or our third-party licensors, in accordance with U.S. and international intellectual property laws. This includes, but is not limited to, all videos, text, graphics, user interfaces, visual interfaces, photographs, moving images, illustrations, files, trademarks, logos, service marks, artwork, computer code, design, structure, selection, coordination, “look and feel,” and arrangement of the Content.

Your use of this Website does not grant you any ownership rights over the Content, and you agree to comply with all relevant intellectual property laws. 12. Indemnification

You agree to defend, indemnify, and hold harmless EIN Filing Services, along with its officers, directors, affiliates, agents, and employees, from any claims, losses, damages, fines, penalties, or other liabilities (including reasonable attorney’s fees) arising from (i) your use of, or inability to use, the Website or Services, (ii) your violation of these Terms, and (iii) your infringement of any third-party rights, including copyright, trademark, trade secret, or privacy rights related to your User Content (if applicable) or your use of this Website. EIN Filing Services reserves the right, at its own expense, to take over the defense and control of any matter for which you are required to indemnify us, in which case you will fully cooperate with EIN Filing Services in asserting any available defenses or counterclaims.

13. Disclaimer of Warranties

Your use of the website is at your own risk. We make no representations or warranties regarding the operation of the website or the information, materials, goods, or services provided on it, all of which are offered “as is.” Without limiting the above, we disclaim all warranties, express or implied, including but not limited to: (1) warranties of merchantability and fitness for a particular purpose; (2) warranties against infringement of any third-party intellectual property or proprietary rights; (3) warranties related to the transmission or delivery of the website; (4) warranties concerning the accuracy, reliability, correctness, or completeness of data available on the website or from EIN Filing Services; (5) warranties related to performance, nonperformance, or other actions or omissions by EIN Filing Services or any third party; and (6) warranties of title. 14. Limitation of Liability

Under no circumstances, including negligence, will EIN Filing Services (or its officers, directors, affiliates, agents, employees, suppliers, or anyone involved in creating, producing, or delivering the website) be liable for any damages or losses. This includes, but is not limited to, direct, incidental, consequential, indirect, special, exemplary, or punitive damages, as well as lost profits, arising from your access to, use of, misuse of, or inability to use the website, its content, user content, or any linked sites. This also applies in connection with any performance failures, errors, omissions, interruptions, defects, delays in operation or transmission, computer viruses, or line or system failures. These limitations apply regardless of whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if EIN Filing Services has been advised of the possibility of such damages.

In no event will EIN Filing Services’ aggregate liability (or that of its officers, directors, affiliates, agents, employees, or suppliers) arising out of or in connection with these terms of use, the website, or the services (whether in contract, tort, negligence, warranty, or otherwise) exceed $100. Because some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, EIN Filing Services’ liability in such jurisdictions will be limited to the extent permitted by law. 15. Applicable Law; Jurisdiction

These Terms are governed by and should be interpreted in accordance with the laws of the United States and the State of California, without regard to their conflict of law principles. By using the Site or Services, you waive any claims that may arise under the laws of any other countries or jurisdictions.

16. Dispute Resolution; Jury Trial and Class Action Waivers; Injunctive Relief

Regarding any disputes related to the Site, Services, or these Terms, you and EIN Filing Services agree to first engage in good faith negotiations to find a mutually satisfactory resolution. If no resolution is reached through informal negotiations within 60 days, any further attempts to resolve the dispute, including those concerning the Privacy Notice and the enforceability of this dispute resolution provision or the Terms, will be exclusively handled through confidential binding arbitration in Los Angeles, California, or another agreed-upon location. This arbitration will follow the Commercial Rules of Arbitration set by the American Arbitration Association (www.adr.org) and will be conducted by a sole arbitrator chosen by both parties in accordance with those rules. The costs associated with administration and the arbitrator’s fees will be shared equally by both parties, although the prevailing party may recover its costs and reasonable attorney’s fees related to the arbitration.

You acknowledge that you are waiving your right to litigate disputes in court before a judge or jury. Instead, disputes will be resolved by a neutral arbitrator, whose decision will be final and binding. Any court with appropriate jurisdiction may enforce the arbitrator’s award. Proceedings will be conducted individually; neither you nor EIN Filing Services will pursue any disputes as a class action or in any representative capacity. No arbitration or proceeding will be combined with others without written consent from all parties involved.

You agree that EIN Filing Services may seek preliminary injunctive relief as permitted by law to enforce these Terms (e.g., for intellectual property claims) while awaiting a final arbitration decision. Any claims or disputes must be filed within one year from when the claim or notice of dispute could first be filed; otherwise, they will be permanently barred. If any part of this section is deemed illegal or unenforceable, that part will be severed, and the remainder will continue to be in effect.

17. Access Outside the United States

If you are accessing the Site from outside the United States, please be aware that your information may be transmitted through and stored on servers located in the United States or other regions. The data protection laws in the U.S. may differ from those in your country, and your information could be subject to requests from U.S. governments, courts, or law enforcement under U.S. law. If any part of these Terms is deemed unenforceable, it will not impact the validity or enforceability of the remaining sections, which will instead be replaced with a provision that best reflects the original intent of the unenforceable part. You also acknowledge that no joint venture, partnership, employment, or agency relationship exists between you and EIN Filing Services as a result of these Terms or your access to the Site.

Furthermore, you agree that we may assign these Terms and any related agreements at our discretion in the event of a merger, acquisition, or similar circumstance. Our failure to enforce any part of these Terms or to respond to any violations does not waive our right to enforce these Terms in the future. Additionally, nothing in these Terms limits our ability to comply with governmental, court, or law enforcement requests related to your use of the Website or Services, or the information we collect in connection with that use.
